Electronic Records and Digital Originals

Why “original” becomes a control question rather than a piece of paper.

Paper logic

Traditional trade relies heavily on paper originals, signatures, possession and physical delivery.

Electronic logic

Digital systems use reliable records, identity, integrity, control and transfer mechanisms to perform similar functions electronically.

Not every PDF is a digital original

A scanned PDF copy of a bill of lading is not automatically an electronic transferable record with the same legal/control effect as an electronic original.

Law and platform matter

Recognition of electronic transferable records depends on applicable law and the system used. Banks therefore need legal and operational comfort, not merely a file attachment.
